Transportation Waiver & Release

T&D Party Wagon

This Transportation Waiver, Release of Liability, and Photography Release (the "Waiver and Release") is made by and between L&B Investments, LLC (the "Company") and the undersigned guest (the "Guest") as of the date of the Guest's acceptance below.

WHEREAS the client (the "Client") and the Company are party to a certain Bus Rental Agreement (the "Rental Agreement") pursuant to which the Company will provide transportation (the "Trip") for the Client and Guests to certain destinations (the "Venues") by means of a certain party bus (the "Bus"); and

WHEREAS the Company has provided the Guest with an opportunity to inspect the Rental Agreement, or an agreement substantially similar thereto;

NOW, THEREFORE, in consideration of the mutual covenants contained herein, the Company and the Guest hereby agree as follows:

Assumption of Risk & Release

I, the Guest, hereby request and agree to have the Company take me on the Trip to the Venues on the Bus. I understand that the Company does not control the Venues or the activities that take place therein and, because of the inherent liability (including risk of serious injury or death) of a Trip, I fully accept and assume all such risks and responsibility for my or others' bodily injuries, property damage, losses, costs, or attorneys' fees incurred because of going on the Trip, whether arising on or proximate to the Bus, at a Venue, or en route thereto.

Indemnification

Further, I agree to release, indemnify, hold harmless, discharge, and covenant not to sue the Company, its members, managers, officers, directors, employees, contractors, or agents (the "Indemnitees") from any liability, claim, demand, loss, or cause of action (including associated attorneys' fees and costs) that arises during the Trip, whether on the Bus, at a Venue, or in transit, sounding in tort, contract or otherwise, from alcohol or drug usage, from my or another's actions or inactions, foreseen or unforeseen, liquidated or contingent, direct or derivative, or otherwise, including if arising from the Indemnitees' negligence (the "Indemnification Obligations"). The Indemnification Obligations arise upon threat of claim, investigation, or litigation and are not tolled until the commencement of an action.

Photography & Videography Release

The Company may take photographs or videos of me during the Trip, such as for promotional purposes. I release any right I have to such photographs or videos.

Conduct

If I exhibit improper behavior, I understand the Company can ask me to depart from the Trip, deny me entry onto the Bus, and require that I find alternate transportation home.

Rental Agreement Incorporated

The terms and conditions of the Rental Agreement are made a part hereof as if set forth fully herein.
